As a condition of using community television facilities and equipment owned by McMinnville Community Media, the above user agrees to the following terms in this Release and Waiver of Liability: 1. INDEMNITIES AND HOLD HARMLESS a) to waive all claims against McMinnville Community Media, (MCM) its employees, directors, officers, and agents, with respect to studio use, including, but not limited to, claims arising as a result of equipment malfunction or failure, accidents, falls, or any other damage while on the MCM premises; b) to release these parties from all liability for personal injury, death, property damage or loss resulting from the use due to any cause, including, but not limited to negligence, breach of any duty imposed by law, breach of contract, mistake(s), action, lack of action, or error of judgment on the part of McMinnville Community Media owners and/or staff; c) to be liable for and to hold harmless and indemnify MCM, its ownership and staff from all actions, proceedings, claims, damages, or liabilities of any kind arising from the use of, or any behavior exhibited during the use session at MCM facilities. 2. MINORS Users are solely responsible for verifying that all personnel involved in their studio production are of legal age for the activities they are engaged in. MCM has no responsibility to determine or verify the age of participants in the User’s activities. Certified Users under 18 years of age must co-sign the parent/guardian and minor agreement with a parent or legal guardian whom accepts full responsibility for loss or damage of equipment. User agrees to be responsible for the conduct and welfare of all persons accompanying User while on our premises. 3. ACCEPTANCE OF RESPONSIBILITY a) The User accepts and assumes all responsibility for all risks resulting from their use of the premises and equipment including, but not limited to, guests, models, assistants, crew, or friends. The User freely accepts these risks and agrees to the terms of this Release. b) The User accepts responsibility for any loss (in the amount solely determined by McMinnville Community Media) or damage to the studio or equipment resulting from User’s activity. The User agrees to pay the costs of repair or replacement for any such loss or damage within 72 hours of a claim from McMinnville Community Media. c) Use of MCM facilities and equipment is at User’s own risk. User waives rights to seek legal redress for mishaps, accidents, and/or loss. User will leave the studio and adjacent areas clean and orderly. Users are solely responsible for any legal infractions User or members of User’s party make including claims of personal abuse, any violation or citations, or legal action resulting from the studio session. Users are solely responsible for the safety and well-being of any participants, guests, assistants, or any other personnel accompanying or engaged by User. 4. PROCEDURES AND REGULATIONS a) RESERVATIONS: We encourage studio reservations well ahead of time; however, no reservations will be taken more than a month in advance. Reservations are on a first-come, first served basis. Reservations may be made in person, via our on-line reservation form, or by phone. We prefer you speak directly with a staff person. Holding more than 6 hours of studio reservations at any one time is not permitted. Please notify us of a cancellation at least 24 hours in advance. b) APPROVED USE: McMinnville Community Media provides studio capacity and equipment for approved Users (producers) who have current activity fees solely for creating programming for telecast on MCM-TV channels. If you use MCM gear, you’re expected to turn in a program for telecast. Use of MCM equipment for private, commercial, or other activities is prohibited, and may result in restriction of further use at MCM’s discretion. c) SECURITY CAMERAS: When occupied by a qualified User, MCM Studio and adjacent work areas are private spaces; however, there are security systems in place that include cameras. You, as the reserving party, and any associates with you are hereby notified of these security systems. Tampering with, obstructing, or in any way manipulating security system equipment may result in criminal charges. d) FORCE MAJEURE: Neither party shall be liable to the other party for failure or delay to meet any obligation under the terms or conditions of this Agreement when such a claim is attributable to causes by greater force, clearly beyond that party’s control and not a consequence of that party’s fault or negligence. e) VIOLATION: If a representative or group should violate any items of this agreement, MCM staff will have the right to terminate their occupancy immediately as well as restrict services in the future. f) INSPECTION: MCM staff shall have the right to inspect the equipment and/or studio at any time during the User’s term.
